Equal Rights for All is an Oregon ballot measure campaign that will affirm the right to abortion, contraception and IVF, transgender healthcare, and same-gender marriage in the Oregon Constitution regardless of what policies or decisions are made on a national level. The Equal Rights for All Measure will be on the November 2026 ballot. 

Each of us — regardless of how we identify or who we love — should be able to live, work, and make deeply personal decisions about our lives with dignity, respect, and equal rights and freedoms. 

The rights and autonomy of women and LGBTQ+ folks are under attack across the country. We can’t control what extremist politicians do around the country, but Oregonians can come together to protect these rights in our state for generations to come. By uniting and fighting for our rights together, we’re ensuring a future Oregon where everyone has equal rights and freedoms.

We’ve experienced relentless attacks on our personal freedoms. A second Trump administration promises to strip us of our freedoms and bodily autonomy by implementing a nationwide abortion ban and destroying access to basic health care including birth control, IVF, and gender affirming care.

These attacks chip away at our basic rights, threatening our right to essential health care including abortion, contraception, and healthcare for transgender people. They also threaten our right to love who we love and marry who we choose. We cannot take these rights for granted — we must fight for them.

It's time we take action to explicitly protect Oregonians’ equal rights, including the freedom to make private and personal decisions about our health, life, and future. We can’t control what extremist politicians do elsewhere in this country, but Oregonians can come together to protect these rights in our state for generations to come.

The Equal Rights for All campaign is a ballot initiative for the November 2026 election. It asks voters to update Oregon’s constitution to make clear that everyone has equal rights to make private and personal decisions  regardless of one’s gender identity, sexual orientation, or if they are pregnant. By protecting Oregonians’ ability to make our own, private healthcare decisions and marry the person we love, our ballot initiative will stop politicians who want to turn back the clock on our basic rights and freedoms.

This language has been approved and designated as Initiative Petition 33 by the Oregon Secretary of State. Find the text on the Secretary of State’s website here.

Section 46, Article I of the Constitution of the State of Oregon, is amended to read:

(1) Equality of rights under the law shall not be denied or abridged by the State of

Oregon or by any political subdivision in this state on account of sex.

(2) “On account of sex” includes laws, policies, and actions that discriminate, in

intent or effect, based on:

(a) pregnancy/pregnancy outcomes and related health decisions;

(b) gender identity and related health decisions;

(c) sexual orientation, including the right to marry; or

(d) sex.

(3) Article XV, section 5a is hereby repealed.

[(2)] (4) The Legislative Assembly shall have the power to enforce, by appropriate

legislation, the provisions of this section.

[(3)] (5) Nothing in this section shall diminish a right otherwise available to persons

under section 20 of this Article or any other provision of this Constitution.

CONTEXT

Why now?

Until our rights to personal freedom and bodily autonomy are protected in the Oregon constitution, we are always just one election or one bad U.S. Supreme Court decision away from losing the right to abortion, gender affirming care, and marriage equality in Oregon.

Across the country, we’ve seen that specifically protecting our rights in state constitutions is a powerful line of defense against extremist politicians who want to attack our basic rights and freedoms. We must act now to ensure these constitutional rights for all Oregonians.

Our Values

Freedom and Autonomy. As Oregonians, we believe that we all should have the freedom to make decisions for ourselves and our families that we need to live and thrive without political control, discrimination, or interference.

Equal Rights. Each of us should be able to live, work, and make deeply personal decisions about our lives with dignity, respect, and equal rights and freedoms. These personal freedoms are rights for all of us — regardless of how we identify or who we love. And we know that historical and systemic inequities mean that some Oregonians, especially people of color, women and LGBTQ+ people, people in rural areas, people experiencing poverty and immigrants and refugees, are especially impacted by restrictions on our rights and freedoms. 

Empathy. There are many reasons why a person may make deeply personal health decisions. Let's lead with compassion, not shame or judgment. Every person should be able to make their own decisions with their doctor and those they love and trust.
